A practical guide to searching the USPTO trademark database on your own — and understanding when you need professional help.
Getting Started
The USPTO trademark database is at tmsearch.uspto.gov. No account required, though logging in provides additional features. The system replaced the legacy TESS with improved technology.
Basic Word Mark Search
Enter your proposed mark and review results for anything that looks similar, sounds similar, or conveys a similar meaning — especially with related goods or services.
Expand Your Search
Phonetic variations. Search alternative spellings. "BYTE" and "BITE" sound identical.
Truncation. Use wildcards to catch root words. "SUMMIT*" returns SUMMIT, SUMMITS, SUMMITVIEW, etc.
Synonyms. Search related terms. "VELOCITY" and "SPEED" share meaning.
Check Related Classes
The USPTO uses "coordinated classes" — groups considered related for confusion purposes. If registering in Class 25 (clothing), also check Class 18 (bags), Class 14 (jewelry), and Class 35 (retail).
Limitations
The USPTO database covers only federal registrations and pending applications. No state registers, no common law marks, no international marks.
When to Hire a Professional
A DIY search works for a quick knockout check. If the check appears clear and you intend to file or commit resources, a professional search covers the gaps — state, common law, and advanced matching with attorney analysis.
